Your privacy is important to us and maintaining your trust is one of our highest priorities. This Privacy Policy includes a description of our information practices, how we use tracking technologies, as well as the decision you may make regarding how your information is collected and used.
OneSignal, a U.S. company located at 2850 S Delaware St Suite 201, San Mateo, CA 94403 (“OneSignal” “we,” “us,” and “our”), provides this privacy policy because we believe that customers should have clear and comprehensive ways to understand how information about them and their end-users is collected and used to provide our service.
OneSignal is a customer engagement platform for companies around the world to enable relationships for them and their customers. This is primarily done by leveraging first party data to personalize and automate messaging through first party channels, such as email, mobile push notifications, web push notifications, and in-app messaging.
OneSignal collects this first party data through a software development kit (“SDKs”) that companies use in their mobile applications and websites. These web and mobile SDKs permit app developers and websites to send, manage, optimize and customize messages to their users. All of these services (further described in this privacy policy) are referred to collectively as our “Services ,” and all of these developers, website operators, and partners are referred to collectively as our “Clients .”
This privacy policy (the “Privacy Policy ”) explains how we may collect, use, store, and disclose information about the end users (“End Users ”) of third-party mobile applications and websites that use our Services. We also collect information on our corporate website(s), including any website on which this Privacy Policy is posted. We separately describe how we collect, use and share that website information (“OneSignal Website Information”) in Section 4, below.

5. Cookies, Pixel Tags and SDKs
Cookies and Pixel Tags. Cookies are small data files containing a string of characters, such as an anonymous unique browser identifier. Cookies are stored on your computer or other device and act as unique tags that identify your device or browser. Our servers may send your device a cookie when you visit the OneSignal Websites, and our Clients and Partners may do likewise on our Websites, our Clients’ websites, and elsewhere. A pixel tag (also commonly known as a web beacon or clear GIF) is an invisible 1 x 1 pixel that is placed on certain web pages. When you access web pages on which a pixel tag is deployed, the pixel tag may generate a generic notice of the visit and permit OneSignal, our Clients or Partners to set or read cookies. Pixel tags are used in combination with cookies to anonymously track the activity on a website by a particular browser on a particular device. If you disable cookies, pixel tags simply detect an anonymous website visit. OneSignal, alone or with our Clients and Partners, may use cookies to, among other things, “remember” you (e.g., when you visit the OneSignal Websites or the websites of our Clients or Partners), track trends, and collect information about how you use our Clients’ or Partners’ websites. We may sometimes use other locally stored objects in ways similar to how we use cookies. Often, these objects are deleted when you clear your browser cookie cache, but because this may not always occur (depending on the browser you use), we recommend that if you wish to opt out of notification features you instead follow the steps we have set forth in Section 7 titled “Consumer Control & Opt-Out Options. ”
Mobile Device Identifiers and SDKs. We may use or work with partners who use mobile SDKs (including our own SDKs, which are described in more detail in this Policy) to collect information, such as mobile device or account identifiers, and information related to how mobile devices and their users interact with our Services and those using our Services. The SDK is computer code that app developers can include in their apps to enable ads to be shown, data to be collected, and related services to be implemented. We may use this technology, for instance, to identify users through mobile applications and browsers based on information associated with your mobile device. We do not collect advertising identifiers such as IDFAs or Android Advertising IDs.

OneSignal is the data controller for processing of your Personal Data. We act as a data processor (or service provider) in relation to the Services we provide to our Clients.

8. Processing Personal Information (EU and UK Visitors Only)
If you are a visitor to our Website from the EEA or the United Kingdom, our legal basis for collecting and using the Personal Data described above will depend on the Personal Data concerned and the specific context in which we collect it.
However, we will normally collect Personal Data from you only where we have your consent to do so, where we need the Personal Data to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect Personal Data from you or may otherwise need the Personal Data to protect your vital interests or those of another person.
If we ask you to provide Personal Data to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your Personal Data is mandatory or not (as well as of the possible consequences if you do not provide your Personal Data).

We will need to confirm your identity and California residency to process your information, access or deletion requests, and we reserve the right to confirm your California residency. Government identification may be required. If you wish to designate an authorized agent to make a request on your behalf, we will need to verify both your and your agent’s identities and your agent must provide valid power of attorney or other proof of authority acceptable to us in our reasonable discretion. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
10. Privacy Shield
OneSignal complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. OneSignal has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. 11. Data Processing
OneSignal applies the Privacy Shield Framework to both data processed solely by OneSignal, as well as to data transferred to third party service providers. When transferring data to third parties, OneSignal complies with the Privacy Shield Principles for Accountability for onward transfers and the onward transfer liability provisions.
12. Data Access and Retention
Generally speaking, we retain the SDK Information and Website Information for as long as necessary to achieve our objectives as detailed in this Privacy Policy, and to comply with our legal obligations, resolve disputes and enforce our agreements.
13. Data Security
We have administrative, technical, and physical safeguards in place in our physical facilities and in our computer systems, databases, and communications networks that are designed to protect information contained within our systems from loss, misuse, or alteration. No method of electronic transmission or storage is 100% secure. Therefore, we cannot guarantee absolute security of your Personal Information and Non-Personal Information.
14. Third-Party Websites and Apps
We are not responsible for the privacy practices or disclosures of websites and applications that use our Services. Likewise, when you access the OneSignal Website, you may be directed to other websites that are also beyond our control. We encourage you to read the applicable privacy policies and terms and conditions of such third parties and websites, and the industry tools that we have referenced in this Privacy Policy. This Privacy Policy, however, only applies to the OneSignal Site and the Services.
15. Users From Outside the United States
The Website and our Services are provided, supported and hosted in the United States, and our operation of them is governed by United States law. If you are using the Site from outside the United States, be aware that your Information may be transferred to, stored and processed in the United States and other countries where our facilities are located. The data protection and other laws of the United States might not be as comprehensive as those in your country. By using the Site you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share it as described in this Policy.

In compliance with the Privacy Shield Principles, OneSignal commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact OneSignal at: privacy@OneSignal.com.
OneSignal has further committed to cooperate with the panel established by the EU data protection authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved Privacy Shield complaints concerning data transferred from the EU and Switzerland.
In the event we are unable to resolve your concern, a binding arbitration option may also be available to you in order to address residual complaints not resolved by any other means. OneSignal is subject to the investigatory and enforcement powers of the United States Federal Trade Commission ("FTC").
17. Changes to This Privacy Policy
We reserve the right, at our sole discretion, to modify this Privacy Policy or any portion thereof. Any changes will be effective from the time of publication of the new privacy policy. If we believe that the changes are material, we will let you know by doing one (or more) of the following: (i) posting the changes on or through the Services, (ii) sending you an email or message about the changes. Your continued use of the Services after the changes have been implemented shall indicate your agreement with the terms of such revised privacy policy. Otherwise, and if the new privacy policy does not suit you, you must no longer use the Services.

Meta Privacy policy
Meta provides features that enable you to run an advertising unit allowing a Meta user to provide their email address or other user information to you (“Lead Ads”). By clicking “Agree” or by using features made subject to these terms, you agree to the following:
A. You are solely responsible for ensuring that each Lead Ad submitted by you complies with these terms, the Meta Terms of Service located at https:www.facebook.com/legal/terms (as defined below, including the Meta Advertising Policies located at https://www.facebook.com/policies/ads, which includes the Lead Ads Policy, the Meta Platform Policy located at https://developers.facebook.com/policy/, and the Meta Commercial Terms located at https:www.facebook.com/legal/commercial_terms) and all applicable laws, rules and regulations (including providing all necessary disclosures to Meta users). If you are accepting these terms on behalf of a third party, you represent and warrant that you have the authority as an agent to such party to use such feature on their behalf and bind such party to these terms.
B. You will ensure that each Lead Ad includes the following disclosures to Meta users: (i) all disclosures and choice mechanisms necessary and sufficient to comply with applicable laws, rules and regulations, including any necessary offer terms promoted in the Lead Ad (e.g., criteria to qualify, expiration date, or limitations on redemption) (“Offer Terms”); (ii) a clear and prominent disclosure that if a user submits data to you through a Lead Ad, such data will be governed by your privacy policy; and (iii) a link to your privacy policy. You will further ensure that no Lead Ads will be targeted to any minors.
C. “Lead Ad Data” means the information that a Meta user elects to send to you through a Lead Ad, which may consist of such Meta user’s email address and any additional user information.
D. You may only use the Lead Ad Data in accordance with these terms; the Meta Platform Policy; the Meta Advertising Policies; your privacy policy; any Offer Terms, consents, additional terms and conditions agreed to by the Meta user when agreeing to provide Lead Ad Data to you through the Lead Ads and applicable laws, rules and regulations (including all applicable data privacy, advertising, telemarketing or other laws). If you are receiving Lead Ad Data on behalf of an advertiser, you may only use or share such Lead Ad Data on such advertiser’s behalf and you may not augment, commingle, or supplement such Lead Ad Data with any other data from any other advertiser.
E. You may only sell or transfer Lead Ad Data as permitted by this section. Lead Ad Data may be sold or transferred if the recipient only uses the Lead Ad Data to fulfill the purpose for which it was collected (as described by a reasonably prominent notice and agreed to by the user at the point of collection). In the event you share or sell Lead Ad Data to a third party, you do so solely at your own risk and you will ensure that any such third party complies with these terms and all applicable laws, rules and regulations.
F. You will have in place appropriate technical and organizational measures to protect Lead Ad Data against unauthorized or unlawful processing and against accidental loss, destruction or damage, and which take into account the nature, scope, context, and purposes of the processing as well as the risks. Lead Ad Data may be made available to you through protocols specified by Meta (including Meta APIs), and your use of such protocols must comply with Meta’s Platform Policy.
G. Meta may modify, suspend or terminate access to, or discontinue the availability of, the Lead Ads feature at any time. You may discontinue your use of the Lead Ads feature at any time.
These terms govern your use of Lead Ads. They do not replace any terms applicable to your purchase of advertising inventory from Meta (including but not limited to the Meta Advertising Policies), and such terms will continue to apply. This Lead Ads feature is part of “Meta” under Meta’s Terms of Service (https://www.facebook.com/legal/terms, the “Meta Terms”), and your use of the Lead Ads feature is deemed part of your use of, and actions on, “Meta.” In the event of any express conflict between these terms and the Meta Terms, these terms will govern solely with respect to your use of the Lead Ads feature and solely to the extent of the conflict. Meta reserves the right to monitor or audit your compliance with these terms and to update these terms from time to time, and your continued use of this feature constitutes acceptance of those changes.
